What you need to know about sexual assault

Sexual assault is a more serious charge than other types of assault, not only because convicted offenders can be sentenced to years in prison but also because they will have to register as a sex offender if their victim is a minor. Sexual assault, or rape, is sexual intercourse or sexual contact without the consent of the other party or with someone less than 17 years of age. A sexual assault charge can be brought if the defendant:

  • Uses physical force, violence or coercion against the other person

  • Threatens to use force or violence or to harm the other person or a third person

  • Knows that the other person is unconscious, unaware of the conduct or unable to resist (unless that person has consented)

  • Knows that the other person lacks the mental capacity to understand the nature of the act or to resist

  • Is a public servant who coerces the other person

  • Is a health or mental healthcare provider or clergy member who, acting in a professional capacity, exploits the other person’s emotional dependence on him or her

  • Is an employee at a facility where the other person is a resident (unless they are married to each other)

A sex assault becomes the more serious crime of aggravated sexual assault if any of the following is true:

  • The offender causes serious injury or attempts to cause death to another during the assault.

  • The offender puts the victim in fear that another person will be killed, injured, kidnapped or subjected to human trafficking.

  • The offender uses or displays a deadly weapon during the assault.

  • Two or more offenders assault the same person together.

  • The offender uses a date rape drug.

  • The victim is less than 14 years old (even if the offender doesn’t know that), elderly or disabled.

Most simple sex assaults are punishable by up to 20 years in prison, but aggravated sexual assaults are punishable by up to 99 years in prison, and some aggravated sex assaults involving children have a minimum prison sentence of 25 years. Convicts might also be fined up to $10,000.
