What are the different types of immigration crimes?

Immigration offenses are classified as federal crimes that carry significant penalties, like prison sentences, significant fines and probation. But many immigration crimes have a risk that other felonies do not: deportation. Whether you are a legal citizen or not, you could face expulsion from the country if found guilty of an immigration crime. You need the help of an experienced criminal defense attorney to secure your standing in the United States.

Immigration and Customs Enforcement is serious about these types of crimes and is particularly aggressive with investigation and prosecution of people accused in Texas and other border states. Most of my cases fall into one of two categories: illegal smuggling and illegal re-entry.

  • Illegal smuggling: This crime is the transportation or attempted transportation of a person across an international border. Unlike human trafficking, illegal smuggling involves consent between the smuggler and the person being smuggled. The smuggler usually profits from the smuggling.

  • Illegal re-entry: Illegal re-entry is a crime that occurs when a person enters or attempts to enter the United States without government approval. Sometimes the person was previously denied admission into the country, had previously been deported, had been excluded from the country or departed the country with an outstanding order for deportation, exclusion or removal. Illegal re-entry can occur even if the person charged with the crime had not previously been subject to deportation.
